Telstra Business / Austrade Beijing Olympics Trade Mission "Win Business Gold in China" Competition ("Competition")

Terms and Conditions

1. Information on how to enter and prize details form part of these conditions. Entry into the Competition is deemed acceptance of these terms and conditions.

2. The promoter is Telstra Corporation Limited (ABN 33 051 775 556) of Level 7, 35 Collins Street, Melbourne, Victoria, 3000 ("Promoter").

3. The Competition will commence at 9 am Australian Eastern Standard Time ("AEST") on 1 May 2008 and will continue until 5 pm AEST on 25 May 2008 ("Competition Period").

Entry

4. Entry is open to Telstra Business customers who meet the following criteria:

(a) reside in Australia and have an ABN;

(b) have been a Telstra Business customer continuously since 1 May 2006;

(c) have been operating in Australia for at least 36 months as at 1 May 2008;

(d) are more than 60 percent Australian owned with the owner/s responsible for making the key management decisions being based in Australia;

(e) have less than 200 full time equivalent staff as at 1 May 2008;

(f) have, at any time since 1 May 2006, exported goods or services to China;

(g) are not a listed company, franchisee, franchisor, club, co-operative or non-profit organisation;

(h) are not more than 50 percent owned by another business; and

("Eligible Entrants").

5. To enter and be eligible to win, an Eligible Entrant must, during the Competition Period visit www.telstra.com.au/business/chinagold, register for the Competition and complete the entry questions online.

Judging

6. All eligible entries received during the Competition Period will be judged on the innovation, entrepreneurship and long-term strategic planning as demonstrated by their answers to the entry questions ("Judging Criteria"). Judging will be conducted by a panel of judges comprising representatives of Telstra and Austrade (Judging Panel) between 26 May 2008 and 4 June 2008.

7. The Judging Panel will in its sole discretion select 12 winners from Eligible Entrants according to the Judging Criteria.

Prizes

8. Each winner will win:

(a) an invitation for two individuals to attend an orientation evening at the Telstra Experience Centre at 400 George Street, Sydney on 14 July 2008 (winners from states other than Sydney will also receive two return economy class airfares from their state of residence. Overnight accommodation may be provided at the sole discretion of Telstra);

(b) two return economy class airfares from Sydney or Melbourne to Beijing, China (winners from states other than Sydney or Melbourne will also receive two economy class airfares from their state of residence to the nearer of Sydney or Melbourne);

(c) three nights twin share accommodation at the five star central Beijing Hotel, Beijing, China including breakfasts;

(d) an invitation for two individuals to attend a business networking event to be held on Thursday, 14 August 2008 at the Hilton Hotel, Beijing, China;

(e) two tickets for a half day excursion to the Great Wall of China;

(f) two tickets and transfers to three events on the 2008 Beijing Olympic Games program chosen at the Promoter's election; and

("Prize").

8. The Prize must be taken by:

(a) two representatives from the winner's business; or

(b) one representative from the winner's business and that representatives' spouse/partner/companion.

9. Each winner will be notified by telephone by 6 June 2008 and in writing and winners will be published on www.telstra.com.au/business/chinagold on 9 June 2008.

10. All other costs associated with taking and using the Prize are the responsibility of the winner. It is a condition of accepting the Prize that individual selected as a winner has:

(a) a valid and current Australian passport which will have at least two blank visa pages and at least 12 months remaining validity as at 31 August 2008 (or as otherwise required for the purpose of any entry visa to China); and

(b) a valid entry visa for China.

11. The Promoter agrees to provide the winner with visa application forms and instructions for completing the visa application forms, but the winner acknowledges and agrees that:

(a) it is the responsibility of the winner and those individuals to meet any necessary visa requirements that may be imposed by the Chinese Consulate; and

(b) the Promoter will not be held liable for any failure of the winner and the individuals taking the Prize to obtain the necessary visas.

General

12. Each winner acknowledges and agrees that:

(a) nothing in these terms and conditions confer on it any right to use any Olympic logo, trade mark or other indicia or the words "Olympics" (Olympic Indicia) in any advertising, marketing or promotional material or to otherwise represent themselves as sponsoring or being associated with in any way, the Beijing 2008 Olympic Games, the International Olympic Committee (IOC), the Beijing Organising Committee for the Games of the XXIX Olympiad (BOCOG) or the Australian Olympic Committee (AOC); and

(b) unless it obtains the written consent of the IOC, BOCOG or the AOC, it must not use any Olympic Indicia in any advertising, marketing or promotional material or to otherwise represent themselves as sponsoring or being associated with in any way, the 2008 Beijing Olympic Games, the IOC, BOCOG or the AOC.

13. Each Eligible Entrant may enter only once.

14. Prizes are not negotiable, refundable or exchangeable for cash.

15. Winners, and the individuals selected by the winners to take the prize, do so at their own risk.

16. If the Promoter is unable to provide a winner with a nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value.

17. Entries which the Promoter considers to be incomplete, incorrect or incomprehensible, to contain defamatory or offensive content or to infringe third party intellectual rights are not eligible to win. The Promoter accepts no responsibility for late, lost or misdirected entries or for any technical difficulties or periods of unavailability of the entry mechanism during the Competition Period.

18. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry process in any way, or who does not properly comply with the entry process or these conditions of entry, will be ineligible to win.

19. Eligibility of entries and the awarding of prizes is solely within the discretion of the Promoter.

20. By submitting an entry, each Eligible Entrant assigns all rights in its answer and any other material (which is not confidential or sensitive) to the Promoter and consents to the Promoter using the answers and information provided in the entry form in any manner which the Promoter so chooses (including modifying, adapting or publishing the answer and information in whole or in part or not at all), including posting the answers and information on the Promoter’s website, without requiring any payment from the Eligible Entrant.

21. Each winner agrees to participate in the Promoter’s publicity activities as requested.

22. The Promoter will not be held liable for any loss, damage or injury which results directly or indirectly from this Competition, except that which cannot be excluded by law.

23. Representatives of the Promoter will judge all entries, in accordance with term 6. In the case of disputes, the decision of the Promoter is final and binding and no correspondence will be entered into.

24. All entries become the property of the Promoter. By entering this Competition, entrants understand and agree (and will obtain the consent of any individual listed in the entry form and of any individual who takes the prize on the entrant's behalf) that the Promoter may use and disclose the information provided by the entrant on the terms and for the purposes (including marketing) set out in the Promoter's Privacy Statement available at http://telstra.com/res/docs/collectionstatement.asp or by calling 1800 039 059, as if the entrant (and any individual listed in the entry form or who takes the prize on the entrant's behalf) was a Telstra customer.
